ALEXANDER J. FRANCHILLI is an Associate in the Employment, Labor & Workforce Management and Litigation practices, in the New York office of Epstein Becker Green. 

Mr. Franchilli’s experience includes:

  • Representing employers in labor and employment law litigation involving breach of employment agreements, promissory notes, wage and hour violations, wrongful termination, and WARN Act violations
  • Litigating cases concerning unfair competition and breaches of non-competition agreements
  • Providing representation to employers in federal and state courts and arbitrations before FINRA
  • Representing employers in collective bargaining and related proceedings before the National Labor Relations Board (NLRB)
  • Handling disputes and class-action defense under the Fair Credit Reporting Act and the Fair Debt Collection Practices Act and state law Unfair, Deceptive, or Abusive Acts and Practices (UDAP) claims
  • Representing financial institutions in state and federal litigation and appeals, in connection with claims based on breach of contract, fraud, misrepresentation, and breach of implied duty of good faith 

Before joining Epstein Becker Green, Mr. Franchilli was an attorney on the Consumer Financial Services Team at an international law firm. Previously, he worked as a labor and employment and commercial litigation attorney at a New York litigation law firm and as a Public Service Fellow at the Kings County District Attorney’s office.

While attending law school, Mr. Franchilli was a Judicial Intern for the Honorable Victor Marrero of the U.S. District Court for the Southern District of New York and the Honorable Joel Schneider, Magistrate Judge of the U.S. District Court for the District of New Jersey. A Dean’s List graduate, Mr. Franchilli also was awarded the Archibald R. Murray Public Service Award for his pro bono and community service work during his years as a Fordham law student.

Representative Experience

  • Represented an employer in the New York Supreme Court, Commercial Division, pursuing unfair competition, breach of an employment agreement, and breach of duty of loyalty claims; successfully opposed a motion to dismiss
  • Obtained for an employer the dismissal of NLRB unfair labor practice charges based on a collective bargaining agreement dispute
  • Advised an employer in federal ERISA litigation and related mediation
  • Advised an employer on compliance with the WARN Act in connection with the closing of a health care facility
  • Advised a mortgage servicer in connection with a breach of representations and warranties under a purchase and sale agreement based on noncompliance with New York State Banking Law
  • Counseled an international bank on compliance with the Gramm-Leach-Bliley Act and New York State judgment enforcement statutes
  • Successfully tried a breach of contract action based on the enforcement of a liquidated damages clause
  • Represented shareholders in a contested corporate divorce
