This program will focus upon the issues arising in litigation surrounding the duties of furnishers of information under Section 1681s-2 of the Fair Credit Reporting Act (FCRA) to investigate disputes made by consumers to consumer reporting agencies. This program will examine the lessons from case law on Section 1681s-2(b) claims, strategies for defending against these actions, and key compliance lessons for furnishers and their counsel.

The topics will include, when does a furnisher have to investigate, what is the nature of duty to investigate, what constitutes an inaccuracy triggering the duty to investigate, how does the furnisher’s duty to investigate relate to that of the CRA, and what factors do courts look at in assessing a claim brought under FCRA section 1681s-2(b).
