When organizations face commercial litigation, civil and criminal enforcement actions, and internal investigations, they turn to attorney Rebecca Finkel.

She combines courtroom experience, enforcement defense, and regulatory knowledge in a litigation practice spanning industries, with a particular focus on health care providers and life sciences companies.

Rebecca regularly appears on behalf of her clients in state and federal courts, as well as before alternative dispute resolution tribunals. For clients facing government investigations, Rebecca's enforcement defense experience is a significant asset. She has represented clients in civil and criminal investigations by the U.S. Department of Justice, the U.S. Securities and Exchange Commission, and self-regulatory organizations, including the Financial Industry Regulatory Authority and the Public Company Accounting Oversight Board.

Rebecca also maintains an active pro bono practice. She has tried Section 1983 civil rights cases before juries and represented asylum seekers, victims of domestic violence, and parents wrongfully accused of abuse.

Earlier in her career, Rebecca clerked for two federal district court judges in the U.S. District Court for the Northern District of Illinois. This experience provides clients with an attorney who understands how federal judges approach and decide cases.

Representative Experience

Health Care and Life Sciences

  • Currently represents and previously defended a hospital system in a qui tam action in which the government declined to intervene after a multi-year investigation.
  • Represented a hospital system in connection with claims of trade secret theft and breach of contract.
  • Represented a hospital system in securing a dismissal with prejudice of a class complaint alleging fraudulent billing practices. The dismissal was affirmed by the U.S. Court of Appeals for the Ninth Circuit.
  • Represented and obtained a successful settlement on behalf of a physician and the founding member of dozens of urgent care facilities in multiple lawsuits relating to the company’s acquisition, including claims for tortious interference, breach of contract, and access to books and records.
  • Provided strategic advice and litigation updates to multiple major pharmaceutical companies on timely issues, including, for example, with respect to 340B Programs, the False Claims Act, and attorney-client privilege considerations.
  • Advised an academic medical system’s staff on concerns regarding patient Fifth Amendment issues and interactions with law enforcement.

Insurance and Financial Services

  • Defended a national health plan against RICO claims and secured the dismissal of the complaint with prejudice.
  • Represented a broker in negotiations with his trading firm and in FINRA proceedings relating to a historic loss on the Volatility Index. Rebecca obtained a successful settlement on the broker’s behalf.

Government Investigations and Regulatory Matters

  • Represented multiple clients across industries in responding to DOJ Civil Investigative Demands (CIDs).
  • Represented a major accounting firm in proceedings before the Public Company Accounting Oversight Board.

Asset Forfeiture and Cryptocurrency

  • Represented an individual in a civil asset forfeiture case involving seized cryptocurrency.

Tax and Commercial Litigation

  • Represented a major online travel company over multiple years and in various jurisdictions relating to whether the company owed certain hotel occupancy taxes based on its online reservation model.
