Overview
When health care organizations and businesses across a broad range of industries face complex litigation, contractual and regulatory disputes, or post-acquisition challenges, they turn to attorney Megan Thibert-Ind.
A trial-tested litigator who brings a pragmatic, business-focused approach to dispute resolution, Megan is versed in both the boardroom and the courtroom.
She brings more than two decades of experience representing hospital systems, academic medical centers, ambulatory surgery and urgent care centers, pharmacy services providers, life sciences companies, and other clients. Having tried numerous cases to verdict in state and federal courts nationwide, as well as before the American Arbitration Association (AAA) and other alternative dispute resolution tribunals, Megan deftly guides her clients through the entire life cycle of the controversies that impact their businesses. Her practice spans health care litigation, commercial disputes, product liability defense, and pro bono advocacy—giving clients a litigator who understands the legal, regulatory, and business dimensions of the matters they face.
Within health care, Megan covers the full range of controversies that clients encounter. She counsels companies investing in or acquiring health care entities and advocates for hospitals and other providers in practice management and shareholder disputes. Megan also works extensively with life sciences clients, advising companies on 340B Drug Pricing Program reimbursement and indemnification claims and defending companies facing product liability exposure, including in international forums.
Beyond health care, Megan has handled complex commercial litigation across industries ranging from energy and financial services to food and beverage and online travel. She regularly navigates complex expert witness issues and has served as lead trial counsel in high-stakes matters involving the U.S. Department of Justice (DOJ) and federal regulatory enforcement.
Megan is also an active member of the Chicago community and is committed to providing pro bono services across a broad range of subject matters. She has represented undocumented immigrants; victims of gender-based hate crimes, domestic violence, and employment discrimination; not-for-profit arts organizations; and parents wrongfully accused of abuse. In 2024, Megan was named the American Heart Association’s Go Red for Women® Chicago Woman of Impact™ Winner for her work to raise awareness of women’s heart health.
What Megan Delivers for Clients
- Health Care Litigation Depth: Health care organizations do not litigate in a vacuum—every dispute carries regulatory, operational, and reputational dimensions that a litigator unfamiliar with the industry can easily miss. Megan’s depth in health care means clients get an advocate who anticipates those dimensions from day one.
- 340B and Life Sciences Defense: Few areas of health care litigation require more technical precision than 340B reimbursement disputes and product liability defense. Megan brings to these complex areas the scientific fluency and regulatory precision they demand.
- Complex Commercial Litigation: From multimillion-dollar commercial disputes to a $250 million federal enforcement action, Megan has litigated high-stakes matters across industries in state and federal courts and before arbitration tribunals nationwide. That record sharpens judgment on when to fight, when to settle, and how to protect a client’s interests at each stage.
- Expert Witness Management: Megan regularly handles complex expert witness issues, including financial analysis, lost profits and damages, and causation and liability, that are often pivotal to the outcome of commercial and health care disputes. Clients benefit from a litigator who knows how to turn expert testimony into one of the strongest elements of their case.
- Post-Acquisition Dispute Resolution: Companies that have acquired or invested in health care entities can face disputes that are as legally complex as they are difficult to resolve without disrupting the business. Megan has represented clients on both sides of those disputes, giving her a 360-degree view of how they arise and how to resolve them favorably.
