Greg’s information technology, privacy, and data protection practice focuses on the following:

  • Serving as lead counsel for a wide variety of information technology vendor services, data processing, data transfer, software licensing, and Software-as-a-Service (SaaS) agreements.
  • Providing readiness assessments and compliance counseling on applicable federal, state, and foreign laws, including GDPR, PIPEDA, CCPA, CPRA, CAN-SPAM, COPPA, GLBA, and state data breach laws.

A registered patent attorney, Greg assists clients with:

  • Trademark portfolio management, predominantly in the United States but also in Canada, Mexico, the United Kingdom, the European Union, and China, including pre-filing clearance, filing strategy, prosecution, maintenance, and monitoring; Trademark Trial and Appeal Board, Uniform Domain-Name Dispute-Resolution Policy, and social media enforcement; co-existence agreements; infringement investigation and resolution; and advertising and sweepstakes review.
  • Licensing, assignments, and corporate transaction due diligence involving patents, copyrights, trademarks, and trade secrets, as well as service contracts primarily involving information technology.
  • Copyright prosecution, fair use, and ownership rights counseling and policies; infringement counseling; dispute resolution; and online enforcement via Digital Millennium Copyright Act and social media platforms.

  • Arbitrations and mediations, administrative hearings before the U.S. Patent & Trademark Office, and arbitrations before ICANN-approved internet domain name dispute resolution organizations.
  • E-discovery, including the implementation of litigation plans for preserving, collecting, reviewing, and producing electronically stored information.

Experience

  • Obtained over $1 million recovery in actual damages and attorney’s fees for copyright infringement of a client’s business document by a competitor. We successfully defended the client’s award before the Sixth Circuit Court of Appeals in view of the defendant’s scènes à faire arguments.
  • Won multiple domain name transfers under the Uniform Domain Name Dispute Protocol on behalf of clients in a variety of industries.
  • Developed website and mobile application privacy policies and terms of service to comply with GDPR and CCPA for clients in the fields of health care, manufacturing, retail, online technology services, and education. Greg drafted related service provider and data transfer agreements.
  • Managed an intellectual property portfolio for a health care system, including trademark clearance, registration, and maintenance, copyright clearance, intellectual property licenses and assignments, and employee policies and procedures regarding the use and protection of intellectual property.
  • Reviewed and negotiated information technology vendor service agreements for a health care system, including agreements for SaaS, digital marketing, and telehealth.
  • Structured, drafted, and negotiated intellectual property agreements and conducted related due diligence for a health care system’s acquisition of a rural hospital.
  • Structured, drafted, and negotiated agreements for a hospice data analytics SaaS offering, including technology vendor agreements, reseller agreements, and customer agreements.
  • Managed a trademark portfolio for a national real estate investment trust, including clearance, registration, and maintenance.
  • Defended the Supreme Court of Ohio, including each of its justices, in a case involving certain provisions of the Code of Judicial Conduct relating to election campaign conduct.
  • Successfully drafted and prosecuted a family of patents covering a supercritical fluid extraction apparatus on behalf of an equipment manufacturer.
