As the individual insurance exchanges prepare to launch on January 1, 2014, many hospitals, physicians and other providers are signing new agreements to participate in networks for products being offered on these exchanges. The exchanges raise various new legal issues and payment and contracting risks that providers should consider when reviewing proposed agreements/amendments from health plans that offer such products (called qualified health plans or "QHPS").
