Predicting how a U.S. Supreme Court nominee may ultimately rule in a particular case not yet before him or her may be a fool’s errand (see predictions about future Justices Earl Warren and David Souter, among others). But with Judge Neil Gorsuch, President Donald Trump’s nominee to fill the vacancy created by the death of Supreme Court Justice Antonin Scalia, his prior opinions are rather instructive as to how he may approach labor and employment issues that come before the court should he be confirmed — which is widely expected.
