“The EEOC reiterates that blanket policies are presumptively discriminatory,” Epstein Becker Green PC’s Nathaniel M. Glasser said. “Employers have to be aware of that, but even further, [policies] need to be narrowly tailored, and the EEOC won’t view them as being lawful unless they’re job-related and consistent with business necessity.”
