New York seems prepared to champion the cause of victims of wage theft. While proper payment of wages has been a long-standing employer obligation, recent developments suggest that wage payment enforcement efforts are riding shotgun in the minds of New York legislators and agency officials. Employers should be aware of proposed legislation that, if passed, would increase (1) employee awareness of the wages owed to them and (2) penalties for nonpayment of wages. You should also be aware of recent enforcement actions and guidance on wage deductions by the New York State Department of Labor (NYSDOL).
