Melissa Jampol, a former prosecutor who now practices at Epstein Becker Green, said the memo marks a return to the strict outlook espoused by former Attorney General John Ashcroft.

“It's going to make it more difficult for defendants to present evidence of mitigation to prosecutors because it prioritizes the concept of the highest provable crime,” Jampol said.
