The EEOC's Tuesday lawsuits against Scott Medical Health Center in Pennsylvania federal court and Pallet Cos. in Maryland federal court are the first to argue that Title VII’s protections against gender bias extend to sexual orientation, an idea that reflects a perspective articulated in the agency’s 2013-2016 strategic enforcement plan and subsequent agency rulings and information campaigns, attorneys say.
“All of this just kind of shows how important the EEOC sees these issues and how broadly they interpret the issues and the aggressive approach they’re taking,” management-side attorney Jeffrey M. Landes of Epstein Becker Green said.
