If services are sufficiently poor, prison time can result. For example, in a 2014 case, the Eleventh Circuit affirmed a nursing home owner's 20-year sentence, half of which was attributable to conditions that saw seniors living among garbage, insects and leaky roofs.
"When I see the report coming out today and the entities that are involved in this task force, I think the immediate risk for [nursing homes] is the risk for criminal exposure," Epstein Becker Green member George B. Breen said.
