A federal appeals court’s recent ruling upholding, for now, a New York ban on weight loss and muscle-building supplements to minors highlights a growing risk for supplement companies. …
Elena Quattrone, a partner at Epstein Becker Green, said the laws already passed by New York and other states were part of a trend that she expected to continue, possibly even with more stringent laws setting an age limit of 21.
“It raises an important business question for the industry,” she said, noting that a proliferation of such laws could represent a major loss in revenue. …
“Monitoring the legislation in this area will be essential, and lobbying, as they have, for their position will be helpful,” Quattrone said.
