David Garland, a member in Epstein Becker Green's employment, labor and workforce management practice, said the upcoming presidential and congressional elections “will undoubtedly be the biggest story for the remainder of the year” for their potential impact on both the Supreme Court and future legislation.
“The outcome will impact the makeup of the Supreme Court. Equally important, if the Democrats win the White House and achieve majorities in the House and Senate, then we can expect pro-labor legislation to be passed and enacted,” Garland said. “In the meantime, in the remaining days of the Obama administration, the DOL, NLRB and the EEOC will continue to push their agendas through rulemaking and lawsuits.”
