Eric Neiman and Emma Pelkey, Members of the Firm, co-present "Nondiscrimination in Healthcare: Implementing Section 1557 of the ACA" at the Oregon Health Information Management Association (ORHIMA) 2025 Annual Meeting, which runs from May 15 to 16.

Section 1557 of the Affordable Care Act is the first federal antidiscrimination law that specifically applies to healthcare programs and activities. Section 1557 has been the subject of many regulatory actions and court cases since the ACA was passed in 2010, and more change is taking place under the new administration. This session will focus on how Section 1557 applies to health information management, the status of current regulations and enforcement, and what upcoming actions might take place.

Learning objectives include:

  • Section 1557 and its regulations: brief background
  • The 2024 Final Rule and how it applies to HIM
  • Regulatory requirements, including those applying to accessibility and AI
  • What changes might take place going forward
