Law360 Employment Group of the Year AwardAccording to Law360, EBG’s convincing the U.S. Court of Appeals for the Fifth Circuit to strike down a major U.S. Department of Labor rule governing employers’ ability to take tip credits out of servers’ wages was “a blockbuster achievement that snagged it a spot as one of the 2024 Law360 Employment Groups of the Year.”

Law360 also noted that the firm’s work to bolster a challenge to the Federal Trade Commission’s ban on noncompetes, as well as a pair of litigation wins for recruiting and staffing agency Aerotek, rounded out the decision to award the firm with this year’s honors.

Significant Achievements

A landmark achievement is our Restaurant Law Center v. U.S. Department of Labor success in challenging the 80/20/30 Rule. The Fifth Circuit ruling marks what appears to be the first federal appellate decision addressing the validity of a regulation post-Supreme Court Loper Bright, impacting the restaurant, hospitality, and gaming industries while establishing an analytic framework for evaluating regulations in a post-Chevron context. – Paul DeCamp, Kathleen Barrett

Our amicus brief in the U.S. District Court for the Northern District of Texas in the case of Ryan, LLC v. Federal Trade Commission on behalf of 11 trade organizations representing thousands of companies employing millions of workers across the U.S. economy. Most members would qualify as “employers” under a new FTC rule, yet its implementation could disrupt their contractual relations with workers. – Erik Weibust, Katherine Rigby, Carolyn Boucek, Millie Warner, Edward Loya, Jr.

We obtained a complete defense verdict on behalf of Aerotek, Inc., a temporary staffing company, following a contentious two-week jury trial in the Superior Court of California for the County of San Diego on defamation and pregnancy discrimination claims in which the plaintiff sought $34 million. – Michael Kun, Benjamin Runge, Catherine Kang

We also achieved a major victory for Aerotek in a proposed class action and PAGA case involving approximately 100,000 California employees, with more than $300 million in potential exposure. EBG was able to get the proposed class claims dismissed based on the named plaintiff’s arbitration agreement and then prevailed on all claims against the plaintiff in arbitration. The arbitration award was subsequently confirmed by the trial court, and the PAGA claims were dismissed. – Michael Kun, Kevin Sullivan, Catherine Kang

Our team’s internal investigation for a large fitness and wellness franchisee related to allegations of employee malfeasance, which garnered media coverage and criminal charges against the employee, involved attorneys in our employment and white collar practices.
