Stuart M. Gerson and Gary W. Health-care lawyers take note: One of your own has been nominated to be a judge on a federal appeals court.

Paul B. Matey, currently senior vice president, general counsel, and secretary at Newark, N.J.’s University Hospital, will bring a hospital insider’s experience to the U.S. Court of Appeals for the Third Circuit, if confirmed. While many federal court judges litigated health-care-related matters while in private practice, and several served in federal legal offices that investigate fraud, Matey appears to be one of few with substantial health-law experience.

That background should serve him well in the Third Circuit, which regularly reviews lower court decisions in critical areas affecting health law, including antitrust law, False Claims Act litigation, and cybersecurity issues, Stuart M. Gerson, a member of Epstein Becker & Green PC’s litigation and health law practices, told Bloomberg Law. Gerson, who is in the firm’s Washington office, is a former acting U.S. attorney general and assistant attorney general for the Civil Division of the Department of Justice.

Gary W. Herschman, also a member of Epstein Becker & Green PC, told Bloomberg Law that it would be good to have “more federal judges with knowledge of all facets of the health-care experience,” including reimbursement, insurance, the FCA, the Stark law, and anti-kickback statute. Herschman practices in the firm’s Newark and New York offices.
