Upon learning of a threatened or filed wage and hour class or collective action, a business needs to take several steps at the outset and needs to do so fairly quickly. What are the first steps an employer should take?
Attorney Paul DeCamp recommends these steps:
- Make sure that information about the lawsuit ends up in the hands of the right in-house and outside counsel.
- Identify the core working group that's going to be responsible for handling the matter.
- Look closely at the allegations in the complaint, and get a sense of the realistic exposure presented by the matter.
