President Joe Biden's announcement Tuesday that he will nominate Julie Su for labor secretary received praise from worker attorneys and advocates, while management-side lawyers voiced concerns that she would increase wage and hour enforcement.

Before Tuesday's announcement, Su, who is currently the deputy labor secretary, had been widely considered a front-runner to replace Labor Secretary Marty Walsh, who had said he would be leaving the U.S. Department of Labor in March. …

Concerns About California

Another DOL veteran of a Republican administration, Paul DeCamp of management-side firm Epstein Becker Green, said there are mechanisms in place that would prevent Su from remaking the DOL in the California model, but there still could be more enforcement.

"There's always going to be a suspicion that a labor secretary from California will try to import California's standards into federal law," said DeCamp, who served as DOL Wage and Hour Division administrator under former President George W. Bush. "There are some significant statutory obstacles to doing that ... but I think what we will see is aggressive enforcement."
