Epstein Becker Green announced today that Brian E. Spang has rejoined the firm’s Employment, Labor & Workforce Management practice as a Member of the Firm in Chicago.

Spang returns after four years as a partner at K&L Gates, where he continued to develop his trade secret and employment litigation practice. Spang brings 27 years of experience representing employers in high-stakes disputes involving trade secret misappropriation, restrictive covenant enforcement, and employment defense.

The legal landscape for trade secret protection and employee mobility continues to be hotly contested. As companies increasingly compete for specialized talent, the risk of trade secret theft and restrictive covenant disputes has intensified across industries, from financial services to technology to health care. At the same time, employers navigating wage and hour class actions and employment discrimination claims face heightened litigation risk from aggressive plaintiffs’ lawyers.

Spang’s practice focuses on two closely related areas: trade secret and employee mobility litigation, and employment defense. His representative experience includes:

  • Representing clients in emergency injunction proceedings—obtaining temporary restraining orders (TROs) enjoining departing employees from soliciting clients and misusing confidential information, and defeating TRO and preliminary injunction motions brought against clients who have hired talent from competitors.
  • Defending Fortune 50 financial services companies, technology firms, insurance companies, and multinational employers in trade secret misappropriation and restrictive covenant matters.
  • Defending employers in wage and hour class and collective actions, including defeating motions for conditional certification under the Fair Labor Standards Act and securing appellate affirmances of trial court victories on behalf of Fortune 50 clients.
