Paul DeCamp and Gretchen Harders, Members of the Firm, co-presented the webinar “Do Employers Need to Pay an Overtime Premium on Benefits?: March 29, 2019 DOL Notice of Proposed Rulemaking on Definition of ‘Regular Rate of Pay’ Under the FLSA” for the ERISA Industry Committee.
The DOL has issued a proposed rule on the “regular rate of pay” definition under the Fair Labor Standards Act (FLSA). While the proposal provides helpful examples that clarify that wellness programs and certain tuition benefits need not be included in the “regular rate of pay,” it does not address the exemption of other benefits such as discretionary profit-sharing plan contributions and certain self-funded health and welfare arrangements.
This webinar discussed the proposed regulations, the possible impacts to employers and employees, and how plan sponsors can weigh in to urge the DOL to make necessary changes in the final rule.
