After 12 years of litigation and after twice defeating motions for class certification, EBG has obtained an award of summary judgment in Los Angeles Superior Court on behalf of an insurance company client on all claims in a heavily litigated, multi-defendant wage-hour class action in which plaintiffs were seeking more than $200 million. Plaintiffs, who worked as property inspectors for vendors our client contracted with, contended that our client was their “joint employer” and liable for alleged misclassification as independent contractors, unpaid overtime, minimum wage, missed meal and rest periods, and unpaid business expenses. In the motion for summary judgment, EBG argued that our client was not a “joint employer,” and the court agreed that plaintiffs did not satisfy any of the multiple standards for an employer-employee relationship that could apply in California.
