NEW YORK (Jan. 29, 2013) — The Labor and Employment practice at Epstein Becker Green (EBG) recently published a Wage and Hour Division Investigation Checklist, which provides employers with valuable information about wage and hour investigations and audits conducted by the U.S. Department of Labor (DOL). Like EBG's first-of-its kind Wage and Hour App, which provides detailed information about federal and state laws, the Checklist is a free resource offered by EBG.

The Checklist, created by EBG's Labor and Employment attorneys, provides step-by-step guidance on the following issues: preparation before a Wage and Hour Division investigation of the DOL; preliminary investigation issues; document production; on-site inspection activities; employee interviews; and back-wage findings, and post-audit considerations.

"The multitude of wage and hour claims and lawsuits that workers have filed under the Fair Labor Standards Act and its state law counterparts have made wage and hour law the nation's fastest growing type of litigation. And federal and state agencies are investigating and pursuing wage and hour claims more aggressively than ever," said Michael Kun, the national Co-Chairperson of the firm's Wage and Hour, Individual and Collective Actions practice group. "We hope that our Checklist will serve as an important resource for employers to use when confronted with an audit — and perhaps help them avoid an audit altogether."

About EBG's Wage and Hour Capabilities

Epstein Becker Green has some of the most respected litigators, counselors, and authors in the field of wage and hour law. With decades of combined experience, the firm's labor and employment attorneys offer an exceptional breadth and depth of knowledge that allows us to assist clients in three primary areas: compliance, litigation, and training. EBG attorneys handle compliance audits of all aspects of a company's adherence to the requirements of the Fair Labor Standards Act ("FLSA") and state wage laws that may be undertaken as a result of a lawsuit, a Department of Labor investigation, due diligence in a transactional setting, or a self-audit initiated by an employer. In addition, our attorneys aggressively and creatively defend wage and hour lawsuits, whether they involve exemptions, working time, wage calculations, meal and rest periods, or other wage and hour issues. Our attorneys also have the knowledge and skills to provide clients with candid assessments of the cases and to negotiate favorable settlements, when appropriate. To help avoid claims and limit potential exposure, EBG has developed innovative techniques for clients and offers wage and hour training to human resources personnel, in-house counsel, and managers.

EBG also has Wage & Hour Defense Blog that offers employers with timely insight and commentary on wage and hour law developments affecting them.
