VICTORIA SLOAN LIN is an Associate in the Employment, Labor & Workforce Management and Litigation practices, in the New York office of Epstein Becker Green. She was selected to the New York Metro Rising Stars list (2012 to 2016) in the area of Employment Litigation: Defense and Business Litigation.

Ms. Sloan's practice focuses on state and federal litigation involving diverse and complex employment and commercial disputes. She represents clients in a wide range of industries, including health care, financial services, retail, legal, and medical billing, and has served as second chair in several New York and New Jersey federal district court trials.

Ms. Sloan:

  • Represents employers in federal and state court on matters involving discrimination, harassment, retaliation, contracts, and other employment-related issues
  • Defends corporate and institutional clients in actions brought pursuant to the Americans with Disabilities Act (ADA), including public accommodation litigation
  • Advises on and litigates a wide variety of business disputes, including breach of contract, construction litigation, and architectural and legal malpractice
  • Represents clients in False Claims Act litigation, including matters premised on the violation of anti-kickback statutes and OASAS licensure
  • Litigates environmental contamination claims brought under New York State Navigation Law, CERCLA, and the New Jersey Spill Act, and claims arising from underground storage tanks and nuisance

Ms. Sloan's recent experience includes:

  • Defending employers in matters brought under Title VII, the New York State Human Rights Law, and New York City discrimination laws
  • Resolving actions brought pursuant to the ADA involving large-scale entertainment facilities and retail establishments
  • Defending business litigation actions in an array of industries, including financial services, HIPAA confidentiality issues, information technology, website development, and public relations
  • Mediating an architectural malpractice action involving a New York City hospital
  • Litigating a qui tam action in federal district court on behalf of a hospital, which involved the disclosure of substance abuse patient records pursuant to the federal regulations stated in 42 C.F.R. Part 2
  • Obtaining judgment and declaratory relief in federal district court on CERCLA and New Jersey Spill Act environmental cost recovery claims following a three-month trial
  • Defending chemical and pharmaceutical manufacturers in products liability actions involving medicines and pesticides
  • Obtaining summary judgment for a pharmaceutical manufacturer in a federal district court action alleging failure to warn of the side effects of a prescription sleep aid
  • Obtaining a defense judgment in federal district court in a case alleging delay in commercial redevelopment as a result of alleged contamination from an underground storage tank
  • Representing a wholesale manufacturer against a variety of unfair labor charges and prevailing before an administrative law judge on charges issued by the NLRB
  • Obtaining a preliminary injunction enjoining a union from invoking the arbitration clause in an expired collective bargaining agreement

During law school, Ms. Sloan served as an Articles and Notes Editor of the St. John's Law Review.
