Susan Gross Sholinsky, a Member of the Firm in the Labor and Employment practice, in the New York office, was quoted in an article titled "Check These Legal Boxes When Expanding Your Volunteer Services."

Following is an excerpt:

In building your volunteer force, make sure to protect yourself from the increased liability to which it might expose you. ?...

"In the opinion of the New York State Department of Labor, there is no such thing as a 'volunteer' at a for-profit organization for workers' compensation purposes," says attorney Susan Gross Sholinsky. ?...

Make sure your liability insurance explicitly covers actions by your volunteers as well as by your employees — because you are responsible for their actions while they're on the clock, Sholinsky says. ?...

"If the organization specifically advised the volunteer not to engage in, say, bed-lifts, that likely would be considered in connection with the question of liability" if the volunteer ignored her training and injured a patient by trying to do them, says Sholinsky.
