The U.S. Department of Justice, the U.S. Department of Health and Human Services' Office of the Inspector General, and other state and federal governmental authorities have intensified their investigative focus on health care entities. These federal and state agencies have enhanced enforcement weapons that subject health care providers to increased exposure to civil and criminal liability, fines, and exclusion from the Medicare and Medicaid programs. Government agencies are aggressively pursuing providers for allegedly violating the False Claims Act, federal anti-kickback laws, and physician self-referral laws.
