New York, NY (November 9, 2020) – Epstein Becker Green (“EBG”) is pleased to announce that eight attorneys have been promoted to Members of the Firm, effective January 1, 2021. Earning a place in this year’s class are Corey Argust (Employment, Labor & Workforce Management; New York), Erica Sibley Bahnsen (Health Care & Life Sciences; Washington, DC), Shawndra Jones (Employment, Labor & Workforce Management; New York), Alkida Kacani (Employment, Labor & Workforce Management; Newark), Elizabeth McManus (Employment, Labor & Workforce Management; New York), Nancy Gunzenhauser Popper (Employment, Labor & Workforce Management; New York), Jonah Retzinger (Health Care & Life Sciences and Litigation & Business Disputes; Los Angeles), and Lesley Yeung (Health Care & Life Sciences; Washington, DC).
Mr. Argust advises employers on compliance with the requirements of the panoply of federal and state labor and wage and hour laws; counsels clients on all aspects of employee hiring, termination, promotion, and reductions in force; represents clients in collective bargaining, labor arbitration, unfair labor practice, and representation proceedings before the National Labor Relations Board, and advises clients on responses to union organization campaigns. His experience also includes litigating a wide range of employment matters and advising on the intricacies of the Service Contract Act, having worked extensively with government contractors.
Ms. Bahnsen represents a diverse group of health care organizations—including health care systems, physician group practices, pharmacies, clinical laboratories, adult day care facilities, and other health care providers—and their officers and directors, in a variety of enforcement matters at both the state and federal levels. She defends health care and life sciences companies in litigation as well as in connection with federal and state government investigations, False Claims Act (“FCA”) qui tam actions, and internal investigations related to health care fraud.
Ms. Jones counsels employers on questions arising at the intersection of technology and the workplace, and advises employers on complying with applicable laws, rules, and regulations concerning diverse labor and employment issues, such as family and medical leave, disability accommodation, wage and hour matters, anti-discrimination matters, and workplace privacy. She also has experience representing clients in labor and employment-related litigation before state and federal courts and administrative agencies and in alternative dispute resolution.
Ms. Kacani represents clients in employment-related litigation on a broad array of matters, including claims of discrimination, harassment, retaliation, constructive discharge, and wage and hour litigation, concerning state and federal employment statutes. She counsels clients on implementing employment practices and procedures; litigates trade secret, non-compete, non-solicitation, raiding, and other restrictive covenant matters in various industries; and represents businesses in diverse and complex commercial litigation matters.
Ms. McManus represents employers in various industries in both federal and state court and before administrative agencies in cases involving allegations of unlawful discrimination, harassment, and retaliation; wage and hour collective actions; ERISA plan litigation; and other employment-related matters. She also assists employers with the movement of employees between competitive businesses, including restrictive covenants, and counsels clients on novel issues of employee relations.
Ms. Popper counsels clients on compliance with equal employment opportunity laws, the Americans with Disabilities Act, the Family and Medical Leave Act, worker classification issues, and other federal, state, and local statutes governing the workplace. She advises employers in all facets of the employment relationship, from pre-employment considerations and hiring to terminations and post-employment restrictions; conducts workplace training seminars for employees, managers, and human resources personnel; and assists in defending clients in labor and employment-related litigation.
Mr. Retzinger is a co-leader of the firm’s Government Enforcement service team and represents health care organizations and health systems in FCA litigation, governmental investigations, and commercial disputes. He develops comprehensive litigation defense strategies and conducts historical analyses of regulatory schemes and the compliance function, and engages U.S. attorneys’ offices, as well as federal and state governmental agencies, on matters such as intervention, the exercise of the U.S. Department of Justice’s FCA dismissal authority, and the determination of the appropriateness of Corporate Integrity Agreements and other integrity obligations.
Ms. Yeung advises health care providers and health-related companies, financial institutions, and investors of industry trends and policy developments. She advises hospitals, health systems, and other health-related companies on legal and regulatory matters arising under Medicare, Medicaid, and other third-party reimbursement programs; advises clients regarding federal and state health care regulatory issues, including licensing and reimbursement matters associated with change of ownership; and assists health care providers with government investigations relating to health care fraud and abuse arising under anti-kickback laws, the Stark Law, and the FCA.
