Overview
When clients want to safeguard their intellectual property or sue a current or former employee for trade secret misappropriation, they call attorney Dan Levy. Dan has more than 15 years of experience helping businesses protect their intellectual property, including valuable trade secrets, whether through counseling and training or litigation.
Clients appreciate Dan's calm demeanor, his ability to analyze complicated matters and explain them so that the issues are clearly known, and his creative solutions. He also counsels clients on employment law, represents them in investigations, and litigates employment-related issues, including non-competes, non-solicits, raiding, and other employee mobility matters.
Businesses turn to Dan to conduct internal investigations related to possible misappropriation of information, and Dan also conducts a variety of other internal investigations, including allegations of harassment or discrimination. Dan also advises businesses on best practices to protect their trade secrets and confidential information.
When advising a client on a trade secret misappropriation case, Dan helps his client determine the best approach, whether resolving the matter without litigation, filing a civil lawsuit and seeking an immediate temporary restraining order, or referring the case to law enforcement. When litigation can't be avoided, Dan aggressively represents his client's interests in state and federal courts and arbitration.
As the COVID-19 pandemic has caused employment to evolve from the office to remote settings, Dan helps clients revise their policies and practices regarding remote work to stop the misappropriation of intellectual property. He also advises clients on increasing their monitoring efforts to detect any misappropriation.
With an extensive background in emergency medical services (EMS) (and also having served as a volunteer), Dan has a deep understanding of the health care industry and represents many medical device and pharmaceutical clients. He knows their unique trade secrets, from formulas, methods, programs, techniques, and processes to customer lists, customer requirements, product specifications, pricing strategies, and recipes. He also represents clients in other industries, such as financial services.
In addition to his trade secrets representation, Dan advises clients on day-to-day workplace issues, counsels clients on cybersecurity and information governance issues, and defends employers against wrongful termination, discrimination, or harassment claims brought by current or former employees. He also conducts internal investigations for employers relating to violations of company policies and allegations of sexual harassment or discrimination.
Dan's determination also carries over into his personal life. An avid baseball player, he plays in an amateur wooden bat baseball league where his primary position is catcher. Also a golfer, Dan is a Shelton Cup champion, winning the prestigious championship seven times, including the past five years in a row.
In 2021, Dan devoted his spare time volunteering with an agency in New Jersey to assist elderly individuals in securing appointments for COVID-19 vaccinations.
Before joining Epstein Becker Green, Dan was a law clerk to the Honorable Joseph P. Quinn of the Superior Court of New Jersey, Civil Part, Monmouth Vicinage.

- Obtained an order staying a state court action and compelling arbitration leading to a more favorable result for a global financial institution.
- Won enforcement of a non-compete agreement for a New York-based global financial technology services company. The court found that the client's one-year non-compete with global territorial scope was reasonable and the employee was prevented from beginning work at a competitor.
- Protected confidential information and protected against the poaching customers of a New York-based international freight forwarder by a former employee. Dan brought a lawsuit against the former employee and new employer without seeking preliminary injunctive relief and obtained restrictions on the current employment without a non-compete agreement.
