All Eyes on DOJ Dismissals
The DOJ’s so-called Granston memo will celebrate its first birthday on Jan. 10, marking one year since the document directed government lawyers to consider tossing FCA cases filed by whistleblowers when needed “to advance the government’s interests, preserve limited resources and avoid adverse precedent.”
The memo appeared to make a splash in 2018, as the DOJ sought dismissal in a number of significant matters, including a case at the Supreme Court involving Gilead and nearly a dozen cases brought by a company called the National Healthcare Analysis Group.
“In 2019, I’ll be watching to see whether DOJ continues to be more aggressive in managing cases brought by qui tam relators and moving to put meritless claims to an end,” Epstein Becker Green member George Breen told Law360.
