Not only was the decision a total win for the dispatching companies, but it lays out a blueprint for weighing independent contractor status that management and workers alike can consider, attorney for the dispatchers Evan Spelfogel of Epstein Becker Green told Law360 on Wednesday.

“The Second Circuit has laid down a roadmap for companies to follow if they want to bring their workers within the independent contractor ambit,” Spelfogel said. “And it’s giving guidance for plaintiffs attorneys as well, as to what kind of situations might actually truly be employee situations.”

Spelfogel added he was “on cloud nine” after the decision and “probably the best decision [he’s] ever read” in part because it pulled heavily from his briefings.
