Bradley Merrill Thompson, Member of the Firm in the Health Care and Life Sciences practice, in the Washington, DC, office, was quoted in multiple publications regarding FTC charges against medical app developer’s advertising claims and the implications for mobile health app developers.
Following is an excerpt from BNA Snapshot:
Attorney Bradley Merrill Thompson, with Epstein Becker & Green P.C., Washington, told Bloomberg BNA Jan. 21 that the FTC settlement should be a warning for health and wellness software developers, particularly mobile health application developers.
“This is an issue for any standalone software developer, including mobile apps,” Thompson said in an e-mail to Bloomberg BNA. “I think FDA and FTC have at least a tacit understanding that for these software products that fall into the grey area of FDA jurisdiction, FTC will take the lead if the issue is over-promotion.”
