Values & Leadership

As the Managing Director of the firm, Jim has played an instrumental role in the development and enhancement of Epstein Becker Green’s mission, vision, and values.

Early in his tenure, the firm joined forces with Deloitte Legal to expand its ability to serve clients with global employment and workforce needs.

In 2022, Jim joined the Leadership Council on Legal Diversity (LCLD), further demonstrating his commitment to building a more diverse and inclusive legal profession. As part of LCLD's Leaders at the Front initiative, Jim created a Leader's Pledge detailing his personal and organizational commitment to diversity, equity, and inclusion.

Managing Director Shares Insights into the Benefits of Prioritizing Wellness, Diversity, and DEI

As part of our 40th Annual Workforce Management Briefing series, Jim discussed the importance of wellness and the vertical, and horizontal, responsibility of attorneys in law firms and legal departments to take care of co-equals. He goes on to share that, in taking this approach, we reinforce the well-being of the team and inspire individuals to achieve at their highest level. Managing Director Comments on Linking Ethics, Wellness & Performance

As part of our 40th Annual Workforce Management Briefing series, attorney Jim Flynn co-presented on “Ethics Issues During (and After) a Pandemic,” and noted during the program that “Th[e]se things are not just good management tactics—it is good ethics. . . . We need to take care of our co-equals and our teams. . . . Teach, in addition to individual excellence, that sense of team and team work. I think that’s vitally important and creates a broader safety net that both prevents ethical violations and . . . keeps people performing at the highest level. . . . There is a notion not only of individual wellness but of optimal performance.”

Epstein Becker Green’s Managing Director James P. Flynn Elevated to Co-Director of John C. Lifland American Inn of Court

The John C. Lifland American Inn of Court is dedicated to fostering and developing the practice of federal litigation and intellectual property (IP) law. Jim will lead this specific Inn as Co-Director by drawing on his practice experience in IP, his role as EBG’s Managing Director, and his ongoing advocacy of the role civility and values must have in successful law firms and for successful lawyers. For many years he has devoted his time and attention to the firm’s strategic mission, importantly, the role firm culture plays in shaping and supporting the firm’s mission. In doing that, Jim has championed an enduring Values Commitment to qualities shared by the American Inns of Court, including professional growth, mentorship, collaboration, high ethical standards, and focused excellence.

Going for the Win: Clients Want Star Trial Lawyer Who’s a Team Player

In this article, Jim asserts that when it comes to defending most corporations, defense is a team game. The best image for the champion trial attorney should come from a team sport — Michael Jordan seems the right role model, or maybe Bill Russell, the player-coach. Law firms that can implement such an ethos internally and market it externally stand the best chance of successful and repeat retentions by those in the corporate world, where teamwork is highly valued.

Results may vary depending on your particular facts and legal circumstances.

  • Secured a conviction and sentencing for Becton Dickinson after a departing employee downloaded confidential information and trade secrets. Jim obtained an ex parte civil injunction while convincing law enforcement to execute search and arrest warrants that stopped the employee from fleeing the country and replicating a soon-to-be-launched autoinjector-type product.
  • Won a jury verdict for Becton Dickinson after a high-level executive claimed multiple whistleblower violations. The aggressive defense against all claims convinced the jury to rule in his client’s favor and to affirm that the plaintiff had made defamatory statements about the company.
  • Obtained dismissal of a pension plan mismanagement claim brought against Alcatel-Lucent (now Nokia) that exposed the company to multibillion-dollar liability. Though the company also faced challenges by unions and individual employees and retirees, Jim successfully avoided liability for his client.
  • Won dismissal of misfeasance, malfeasance, and fraud claims in connection with PRA Health Science’s clinical trials. In a challenging matter involving complex choice of law, limitations, and other legal issues, Jim is defending PRA’s U.S. entity and its Dutch affiliate in multijurisdictional litigation. To date, Jim has had one of the actions dismissed in New York, defeated attempts to transfer another from Delaware to Minnesota, and had claims against the Dutch affiliate dismissed.
  • Obtained a jury verdict in a trademark and fraud action concerning popular music group The Drifters. As lead trial and appellate counsel, Jim established that a rival had defrauded the U.S. Patent and Trademark Office to obtain registration and secured his clients’ common law priority right to the mark.
