Bradley Merrill Thompson, a Member of the Firm in the Health Care and Life Sciences practice in the Washington, DC, office, was quoted in an article about how the FDA is keeping an eye on app stores.
The article discussed how cell phone apps are blurring the distinction between medical devices - which are strictly regulated by the FDA - and consumer electronics sold openly online.
Thompson said that businesses don't know if the apps they are making will be regulated by the FDA or not. "I think there is a good bit of ambiguity now about which of these apps require FDA clearance. I know a number of investors who are interested in those businesses that are kind of nervous," he said.
