During the campaign of 2008, then-Senator Obama made it no secret that his workplace agenda strongly supported organized labor and increased employee protections. His election has already resulted in substantial changes in labor and employment law, including the Lilly Ledbetter Fair Pay Act (which significantly increases the time period in which many employment discrimination claims can be brought), the reversal of several Bush-era labor policies, and significant whistleblower provisions contained in the economic stimulus package. Now, just a few months into the Obama administration, the Employee Free Choice Act (which would make it much easier for unions to organize workplaces and which would potentially allow an arbitration panel to set workplace pay and benefits) is one of the hottest issues in Congress.
