As all hotels, restaurants, retail stores, and other places of public accommodations should be aware, the Americans with Disabilities Act (ADA) regulates certain standards for accessible design and treatment for individuals with disabilities. New ADA standards were enacted in September 2010 and took effect on March 15, 2012. These new standards set out significant changes for places of public accommodations, to make them readily accessible to and usable by individuals with disabilities, and impose new employer responsibilities that will have immediate legal and financial effects on all hospitality and retail employers. In recent years, there has been a proliferation of cases brought by plaintiffs under the accessibility provisions of the ADA. This trend will only increase further with the promulgation of the new ADA standards, as zealous plaintiffs’ attorneys bring suits on behalf of individuals with disabilities.
