In response to the COVID-19 pandemic, an increasing number of health care providers have considered, developed, and launched telehealth platforms and businesses as a way to efficiently, effectively, and safely provide care to patients. Telehealth businesses must balance their innovative platforms for providing virtual care against a myriad of regulatory issues at both the federal and the state level—many of which have changed dramatically over the last year and will continue to change even post-pandemic. With unprecedented levels of consumer interest and provider adoption of telehealth services, equally interesting questions have arisen about the potential for fraud, waste, and abuse associated with these services as the increasing popularity of telehealth services has been accompanied by a rapid increase in civil and criminal enforcement.
