In terms of congressional challenges to controversial executive action and agency rulemaking during the final two years of Obama's tenure in the White House, the recently announced push to block the election rule is likely just the tip of the iceberg, according to Steven Swirsky of Epstein Becker Green PC.
“We're going to see a lot of this type of skirmishing between the legislative branch and the executive branch. This isn't going to go away; this is probably just the start of it,” Swirsky said, adding the current GOP-controlled Congress has only been in session for about a month.
The NLRB is also in critics' crosshairs for reasons other than the election rule, Swirsky noted, citing the controversial “joint employer” complaints issued against McDonald's USA LLC and franchisees by the agency's general counsel in December as an example.
