The United States citizenship and Immigration Services (“USCIS”) announced late yesterday that it finally has released the new version of the Form I-9, Employment Eligibility Verification, and updated the companion M-274, Handbook for Employers, Instructions for Completing the Form I-9. These documents should be available through the “Forms” section on the USCIS website: www.uscis.gov. Those seeking copies should be sure to download the New Form I-9 (rev. On its website, the USCIS urges employers to begin using the new Form I-9 immediately but indicates that they can continue using the old Form I-9 until December 7, 2007. However, notice of the new Form I-9 has not been published in the Federal Register so it is not clear that the USCIS can enforce compliance with this pronouncement. Nevertheless, we urge employers to begin using the new Form I-9 as soon as possible and certainly on or before December 7, 2007, to avoid potential problems in this area.
