Francesco A. DeLuca, Member of the Firm, presents “National Wage and Hour Litigation Trends and Their Potential Impact” for the Rhode Island Society for Human Resource Management (RISHRM).

Employers across the country are increasingly facing three types of wage-and-hour lawsuits. The first type of suit alleges that employers failed to compensate employees properly for the time they spend logging into and out of their computers each day. The second type asserts that employers did not pay their workers within the timeframes set forth in state wage payment statutes. And the final category contends that provisions in commission and bonus plans requiring that an employee be actively employed as of the date of a payout are unlawful.

Although these claims are different, they share some common features: they permit the recovery of multiple damages and attorneys’ fees, they may give rise to liability on a class basis, and most important, they are popular. Indeed, some of these lawsuits have already begun to make their way to Rhode Island. During this presentation, we will discuss these litigation trends and what Rhode Island employers can do now to identify potential issues and bring their pay practices into compliance.
