On November 5, 2021, the Occupational Safety and Health Administration (OSHA) issued its long-awaited COVID-19 Emergency Temporary Standard (ETS), imposing a number of COVID-19 protocols on employers with 100 or more employees, or approximately two-thirds of the nation’s workforce. The next day, a federal appellate court issued an order temporarily halting the rollout of the ETS nationwide. As employers will have to comply with a number of the ETS’s requirements – including to implement a COVID-19 safety policy, collect employees’ vaccination statuses, and promote vaccination among employees – by December 5, 2021 if the order is lifted, it is critical for them to begin taking steps to comply with the ETS now to avoid a potential OSHA citation in the future.
