The Patient Protection and Affordable Care Act ("PPACA") brought health care reform and, along with it, many new and amended rules governing fraud and abuse. Key changes include amendments to the federal False Claims Act, the Anti-Kickback Statute, and the Civil Monetary Penalty Statute, as well as new rules for the treatment of exchange payments and overpayments. PPACA also brought additional and enhanced enforcement weapons, including a vigorous screening process for new and existing providers and suppliers and the potential for enrollment and payment suspensions. These changes together with an increase in RAC, MIC, and ZPIC audits, make it imperative for a health care provider to proactively implement and update a compliance program to better prevent and detect fraud, waste, and abuse.
