The Texas Medical Board has had zero luck so far gaining a legal victory against telemedicine giant Teladoc. Appealing its case to a higher court — as it announced last week — might not help, say attorneys following the Texas telemedicine battle. Stuart Gerson, an attorney with Epstein, Becker and Green in Washington, told Morning eHealth the case is likely headed to trial, because the 5th Circuit Court of Appeals will surely not reverse the district court’s ruling. The appeal also means the case will take longer to play out.
