“If that was an employer in New York, and it was taking action because of the fact the employee went to this demonstration and engaged in First Amendment conduct, as distasteful and repulsive as it is, I think that’s something that would probably be protected,” Epstein Becker Green labor attorney Steven Swirsky said.
