Repealing guidance documents does not guarantee wage-and-hour regulators in the field will immediately change their approach, Paul DeCamp, former head of the Wage and Hour Division in the George W. Bush administration, told Reuters.
To be certain of a change in the ranks, the Labor Department has to replace the repealed Obama-era policies on joint employment and independent contractors with new guidance, then train field staff on those new interpretations, said DeCamp, who is now co-chair of Epstein Becker & Green’s national wage-and-hour practice.
