A federal judge has determined that the Massachusetts anti-SLAPP statute — at least as currently administered — impermissibly infringes on the right to a jury trial guaranteed by the Seventh Amendment, a decision that may guide the 1st Circuit’s review of a pending appeal and also prompt the Supreme Judicial Court to examine the issue, according to local attorneys.
