George B. Breen of Epstein Becker Green, an FCA attorney who is not involved in the case, described Tuesday's ruling as limited but also another notch in the belt for plaintiffs who are likely to make increasing use of sampling in the future.
"Defendants need to be prepared to challenge this effort, both procedurally and substantively, given these recent rulings," Breen said.
