Health care lawyers expect state lawmakers to prioritize bills regulating artificial intelligence used in mental health care, mandating disclosures to patients when Al is used and establishing Al sandboxes for developers to create innovative products in 2026, despite President Donald Trump's executive order intended to strike down supposedly burdensome state Al laws. …
One broad Al bill health care stakeholders should watch in 2026 is Washington state's HB 2157, which seeks to regulate "high-risk" Al development, deployment and use, Eleanor Chung, associate for Epstein Becker Green, told IHP.
"Unlike Colorado's Al Act, Washington's bill seems to authorize a private right of action, which gives the bill much bigger teeth," Chung said.
