But while many of the struggling insurers have legitimate claims, lawyers say, that doesn’t mean they have a solid case.
“I think right now the government has a good argument that it’s not ripe,” Clifford Barnes, an attorney with Epstein Becker Green, told The Hill. “That’s going to forestall the lawsuits for a number of years, because they do have three years to pay. If I think about what a court will do, if they can put it off for another day, that’s what they’ll do.”
