Attorney Bradley Merrill Thompson, with Epstein Becker & Green P.C., Washington, told Bloomberg BNA Jan. 21 that the FTC settlement should be a warning for health and wellness software developers, particularly mobile health application developers.
“This is an issue for any standalone software developer, including mobile apps,” Thompson said in an e-mail to Bloomberg BNA. “I think FDA and FTC have at least a tacit understanding that for these software products that fall into the grey area of FDA jurisdiction, FTC will take the lead if the issue is over-promotion.”
