Don't Overlook State Privacy Laws
Adam Forman, a member at Epstein Becker Green who specializes in employment issues related to emerging technologies, said that while he isn't aware of any new regulations, court decisions or technologies that would have prompted the EEOC to issue its guidance, the positions it took are consistent with concerns expressed by other federal agencies and some state legislatures.
"I guess this is all part of an overall response to employers implementing technology in the workplace, and ensuring that employers recognize that, 'new tools, same rules,'" Forman said.
